By accessing the Site, browsing our products, or making a purchase, you agree to be bound by the terms, conditions, and disclaimers set forth in this Legal Notice. If you do not agree, please do not use this Site or purchase our products.

2. POWERSPORTS SAFETY WARNING & ASSUMPTION OF RISK (CRITICAL)

All products sold on Deetago—including but not limited to electric scooters, electric dirt bikes, gas-powered dirt bikes, and youth/kids off-road motorcycles—are inherently high-risk action vehicles.

By purchasing, assembling, or riding any Deetago product, you explicitly acknowledge and agree to the following:

  • Inherent Risk: Operating, riding, or being a passenger on powersports vehicles involves inherent risks of serious bodily injury, paralysis, or even death, as well as property damage. You voluntarily assume all such risks, both known and unknown, associated with the use of our products.

  • Safety Gear Mandate: Riders must ALWAYS wear appropriate, high-quality safety equipment at all times, including but not limited to a certified helmet (DOT/UL approved), protective pads (elbow/knee), heavy-duty footwear, and long clothing.

  • Parental Supervision: Products designed for youth, kids, or teenagers (including kids electric/gas dirt bikes) must only be operated under the direct, continuous, and active supervision of an adult. Parents or guardians are solely responsible for determining whether a child possesses the physical coordination, cognitive skills, and maturity required to ride safely.

  • Proper Assembly & Maintenance: Users are responsible for ensuring the product is correctly assembled, regularly inspected, and properly maintained (such as checking tire pressure, brake functionality, and tightening bolts) before every single ride.

3. LOCAL LAWS & STREET LEGALITY DISCLAIMER

Laws governing the operation of electric scooters, electric dirt bikes, and gas-powered vehicles vary greatly by country, state, county, and municipality.

  • User Responsibility: It is the buyer’s/rider's sole responsibility to research, understand, and comply with all federal, state, and local laws, regulations, and ordinances regarding the ownership, licensing, registration, insurance, and operation of Deetago products in their respective jurisdiction.

  • Off-Road Use Only: Many of our off-road motorsports products (especially gas dirt bikes and kids motocross) are designed and sold strictly for closed-course or private property off-road use only. They may not be legal for use on public roads, highways, sidewalks, or public parks.

  • Deetago shall not be held liable for any fines, penalties, tickets, impoundments, or legal consequences resulting from the illegal or unauthorized operation of our products.

4. PRODUCT PERFORMANCE & SPECIFICATION DISCLAIMER

Product technical specifications—including but not limited to maximum speed, range per charge, hill climbing torque, and battery life—are estimations tested under optimal laboratory conditions (e.g., flat terrain, standard ambient temperature, windless conditions, and a specific rider weight, usually around 150 lbs).

  • Actual Performance May Vary: Actual on-road performance, including maximum speed and range, may vary significantly based on the rider's weight, terrain conditions, slope incline, wind speed, riding style, temperature, and battery age.

  • Accuracy of Information: While we strive to provide highly accurate descriptions and media of our products, minor variations in design, color, stickers, and packaging may occur during manufacturing upgrades without prior notice.

5. INTELLECTUAL PROPERTY RIGHTS

All content, graphics, logos, brand names (including the registered trademark "Deetago®"), designs, code, product descriptions, and photographic media featured on this Site are the exclusive property of Deetago and are protected by international copyright, trademark, and intellectual property laws. Any unauthorized reproduction, redistribution, or modification of any material on this Site is strictly prohibited.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall Deetago, its parent company, subsidiaries, affiliates, directors, or employees be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of profits, property damage, medical bills, or personal injury claims) arising from your access to, use of, or inability to use this Site, or from the use or misuse of any product purchased from Deetago.

Our maximum aggregate liability for any product-related claim shall not exceed the actual purchase price paid by you for that specific product.

7. GOVERNING LAW & JURISDICTION

As stated in Section 22 of our Terms of Service, this Legal Notice, the use of this Site, and any transactions arising from it shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR). You and Deetago hereby irrevocably submit to the exclusive jurisdiction of the courts of Hong Kong for any disputes or legal proceedings.
